SEAPORT REGULATIONS OF BA RIA - VUNG TAU AND BINH THUAN PROVINCES

(Issued as an attachment to the Decision No. 421/QD-CVVT dated December 6, 2007 by the Director of Maritime Administration of Vung Tau)

Chapter I

GENERAL PROVISIONS

            Article 1. Scope of Application

            1. The Seaport Regulations shall regulate maritime activities at Seaports in Provinces Ba Ria – Vung Tau and Binh Thuan (here in after referred to as the Seaports for short) pursuant to the Decree No. 71/2006/ND-CP dated 25 July 2006 promulgated by the Government regulating the management of seaports and maritime channels (here in after referred to as “the Decree No. 71/2006/ND-CP”), the Decision No. 46/2007/QD-BGTVT of September 05, 2007, by the Minister of the Ministry of Transport publicizing Seaport waters in Provinces Ba Ria – Vung Tau and Binh Thuan and areas under management of the Maritime Administration of Vung Tau (here in after referred to as Decision No. 46/2007/QD-BGTVT), the Circular No. 10/2007/TT-BGTVT of 06 August 2007 by the Ministry of Transport guiding the implementation of the Decree No. 71/2006/ND-CP (here in after referred to as “Circular No. 10/2007/TT-BGTVT”) and other relevant laws and regulations.

            2. The Seaport waters in Provinces Ba Ria-Vung Tau and Binh Thuan (here in after referred to as “the Seaport waters”), berths, quay, pilot embarking and disembarking area, quarantine area, anchoring area, transshipment area, and storm sheltering area in the Seaport waters are regulated under the Decision No. 46/2007/QD-BGTVT.

            Article 2. Subjects of Application    

            The Seaport Regulations shall apply for organizations, individual, domestic and foreign ships operating in the Seaports.

Article 3. The state management administrations at the Seaports.  

1. Agencies functioning state management of maritime activities at the Seaport shall be the Maritime Administration specifically:

            2. The Maritime Administration of Vung Tau, The Station of the Maritime Administration of Vung Tau, Representative Office of the Maritime Administration of Vung Tau as per item 1 of this Article shall here in after be referred to as the Maritime Administration.
