SEAPORT REGULATIONS IN HO CHI MINH CITY
(Issued as an attachment to the Decision No. 117/QD-CVHHTPHCM dated December 17,2007 by the Director of the Maritime Administration of Ho Chi Minh City)

Chapter 1
GENERAL PROVISIONS Article 1. Scope of Application

1.   The Seaport Regulations shall regulate maritime activitives at the Seaports in Ho Chi Minh City (hereinafter referred to as the Seaports) pursuant  to the Decree No 71/2006/ND-CP dated 25 July 2006 promulgated by the Government, regulating the management of seaports and maritime chanels (hereinafter referred to as “The Decree No 71/2006/ND-CP”), the Decision No 49/2007/QD-BGTVT of September 12,2007 by the Minister of the Ministry of Transport publiczing Seaport Waters in Ho Chi Minh City and areas under management of the Maritime Administration of Ho Chi Minh City  (hereinafter referred to as “The Decision No 49/2007/QD-BGTVT”), Circular  No. 10/2007/TT-BGTVT of 6 August 2007 by the Ministry of Transport guiding the emplementation of The Decree No. 71/2006/ND-CP (hereinafter referred to as “Circurar  No. 10/2007/TT-BGTVT”).

2.    The Seaports Waters in Ho Chi Minh City (hereinafter referred to as” The Seaport Waters “), berths, quay, anchoring area, transhipment area, and storm sheltering area in the seaport waters are regulated under the Decision No. 49/2007/QD-BGTVT3.    The pilot embarking and disembarking area, area for ship inspection shall be limites waters areas as specifically regulated in the Decision No. 49/2007/QD-BGTVT as follows:
a)    Area 1: ( applied for ship or boat, except those regulates in Area 2), shall be the area limited by a semicircle of a radius of 01 mile in the West- Southwest, with the circle centre at the co-ordinate: 10019’48’’6N, 107003’17’’7E
b)    Area 2: (applied for ship or boat carrying petroleum, dangerous or hazadous cargo of 5000 GT or more, ship ar boat having draft of 10 meters or more and other ship or boat requesting to embark or disembark pilot for particular reasons in this area shall be limited by a semicircle of a radius of 01 mile, with the circle centre at the co-ordinate: 10017’04’’3N; 107005’17’’0E

Artice 2: Subjects of ApllicationThe Regulations shall apply for organizations, individuals, domestic, and foreign ships operating in the Seaports in Ho Chi Minh City

Article 3: The state management administrations at the Seaports
1.    The agencies functioning state management of maritime activitives at the Seaports shall be The Maritime Administration of Ho Chi Minh City (hereinafter referred to as the Maritime Administration) at the following venue:
